Except at that point, settling for throwing Lex into prison is malfeasance. Just kill the bastard. Batman, I'm looking at you too, in regards to the Joker, and that guy with the mask. Refusing to kill such as these becomes complicity. === But the situation with Coyote is different. Coyote isn't a villain, he's a power. He's the personification of a human tendency, one which is not necessarily evil. Careless, yes, but unlike Lex, he doesn't set out to commit harm, or to rule. He just wants to party, and to tell stories. Coyote knocked over a mushroom in a Bismuth garden. I strongly suspect that if Coyote attempted to knock over a real building, one with people in it, one with labs and equipment, theaters and stores and classrooms, things would have gone very differently. But that sort of thing is not within his persona. He probably is unable to do such things without inflicting as much pain on himself.
