Nope! You really need to consume more media. A very common trope after a "midgoal" has been achieved in fiction is a timeskip. This can be a short period (such as the summertime timeskips in GKC so far) or a long one (YEARS). This is widely accepted as good writing, if only because it means you don't have moments where a character or group is doing nothing interesting. So a third option would be a future timeskip - possibly of epic proportions. Given, the idea of Annie being locked away would no doubt draw Coyote into a fit, which could re-spark the war between the forest and the court now that the divide is apparently unsealed: a fourth option that would provide us interesting ramifications. Given, it looks like right now the answer is "no, he's living". But ay.

There's also the Coen Brothers type of scenario, where circumstances result in incompetent actions (often in the face of opposing incompetent actions) being far too effective. In which case, Smitty could have died, they intend to fess up to what happened, and then serendipity presents a last second opportunity that a character foolishly takes making everyone believe he died in some terrible unrelated accident...but now they're in that hole and they can only dig themselves deeper with each new turn of events.
I don't think GK is ready to get that intense though
